These Terms of Service ("Terms") form a binding agreement between you and NicheGraph ("NicheGraph," "we," "us," or "our") governing your access to and use of nichegraph.com and the NicheGraph application (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Description of Service
NicheGraph is a YouTube niche-research tool providing channel analytics, video performance data, trend discovery, and related research features. The Service is provided for informational and research purposes.
3. Accounts
You must provide accurate, current information when registering and keep it up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
Accounts are for individual use; sharing, reselling, or transferring access is prohibited unless we expressly permit it in writing.4. Subscription and Billing
NicheGraph is offered as a paid subscription at $29.99 per month, billed monthly in advance.
Subscriptions renew automatically each month until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you retain access until then.
We may change pricing with at least 30 days' notice; new prices apply from your next renewal date.
Prices are exclusive of taxes unless stated otherwise; you are responsible for any applicable taxes.5. Refunds
Payments are non-refundable except where required by applicable law. If you believe you were charged in error, contact us at contact@nichegraph.com and we will review your case.
6. Acceptable Use
You agree not to:
violate any applicable law or regulation;
abuse, overload, or disrupt the Service, including excessive automated access beyond normal use;
attempt to gain unauthorized access to the Service, other accounts, or our systems;
copy, resell, or redistribute the Service or its data except as these Terms permit;
transmit malicious code or interfere with other users' enjoyment of the Service;
misrepresent the source of data obtained from the Service.We may suspend or terminate accounts that violate this section.
7. Third-Party Data and the YouTube API
The Service displays data obtained through the YouTube API and other public sources. Such data is subject to YouTube's Terms of Service (https://www.youtube.com/t/terms) and Google's Privacy Policy (https://policies.google.com/privacy). We do not control YouTube's data, availability, or accuracy and are not responsible for changes YouTube makes to its API, data, or terms.
8. No Guarantee of Results
NicheGraph provides research data to inform your decisions. We do not guarantee views, subscribers, revenue, or any specific outcome from using the Service. Business decisions you make based on the data are solely your responsibility.
9. Intellectual Property
The Service — including its software, design, branding ("NicheGraph"), and original content — is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
11. Limitation of Liability
To the maximum extent permitted by applicable law, our total liability for any claims arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.
12. Termination
You may cancel your subscription at any time as described in Section 4. We may suspend or terminate your access for violation of these Terms, with or without prior notice as circumstances warrant. Sections 9, 10, 11, and 14 survive termination.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified through the Service or by email at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United Kingdom. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
